Section 3C Leave: What Happens When a UK Visa Application Is Pending?

Waiting for the Home Office decision is stressful when your visa expires before it. Section 3C leave exists for exactly that situation. The aim is to stop a person who makes an in time application from becoming an overstayer while they wait for a decision, and while any appeal or administrative review is pending.

While you hold section 3C leave, you keep the same conditions as before. If your previous leave allowed work, you can usually carry on working, and employers may ask for evidence of your status. If it limited your hours, your employer or your training, those limits still apply. A student, for instance, stays within their usual term-time work restriction.

At Axis Solicitors, we understand that delays in immigration decisions can create uncertainty around employment, travel and future plans. Knowing the common mistakes and procedural risks can help you avoid actions that may affect your lawful status in the UK.

This article explains what section 3C leave is, when it applies, how long it lasts and what can bring it to an end. Please note that the rules are technical and depend on your case scenario.

What Is Section 3C Leave Under the Immigration Act 1971?

Section 3C of the Immigration Act 1971 is a short but important provision of UK immigration law. It keeps your existing limited leave alive if you apply to extend it before it ends and the leave runs out before the Secretary of State has decided the application.

Section 3C leave is automatic. It operates by force of law, so you do not apply for it, and you are unlikely to be informed by a letter or a new visa. It simply continues what you already had, so your original visa terms carry on.

Because 3C leave is not a new grant, your online status or an official website may not show it. The Home Office also does not provide a document confirming Section 3C leave. However, you can use the Home Office online service to view your immigration status.

Our article on how to check your immigration status with an eVisa explains what to do if an employer or landlord asks for proof. Where family members applied alongside you, each should check their own position, because individual leaves can differ.

The left column shows that eligible applicants can remain lawfully in the UK, continue working within their existing visa conditions and amend an outstanding application where permitted. The right column warns against leaving the UK, working beyond existing visa restrictions and submitting a separate application to vary leave while Section 3C applies. The comparison highlights the importance of maintaining existing immigration conditions while awaiting a Home Office decision.

When Does Section 3C Leave Apply?

The Home Office guidance sets out the conditions for section 3C leave:

  • You hold limited leave to enter or remain in the UK.

  • You apply to vary that leave before it ends.

  • Your leave expires before that application has been decided.

A letter from the Home Office confirms your pending application for work or other purposes. In some cases, you may need to provide previous visa documentation to prove Section 3C status.

For example, suppose your previous leave expires on 11 April and a valid application is submitted on 10 April. If no decision has been made by 11 April, 3C leave begins and you stay lawfully in the UK. Only a valid application triggers it. An application that is invalid and never validated does not create section 3C leave.

Why timing matters

Section 3C does not extend leave where the application is made after the applicant’s current leave expires. That is why a late filing is so risky. If your leave to remain expires before you apply, there is nothing for section 3C to continue. Before you file, check the requirements in our guide to FLR visa requirements for further leave to remain, so your immigration application is complete and valid.

Section 3C Leave and an Administrative Review

Many refusals are subject to an administrative review rather than an appeal. Section 3C leave continues while an administrative review could be sought and while one is pending. The time limits are 14 days if you are not detained and 7 days if you are detained. Leave then lasts until the review has concluded.

If you miss the relevant time limit, section 3C leave ends at the close of the last day you could have applied. An administrative review requested after that deadline does not extend 3C leave. The detailed rules are in the Immigration Rules, so act quickly once an application is refused.

Section 3C Leave and an Immigration Appeal

If your refusal carries a right of appeal, section 3C leave continues in two stages. It covers the period in which an appeal could be brought while you are in the UK, and any period when such an appeal is pending. That depends on the in country appeal being lodged within the required time limit.

An outstanding appeal keeps section 3C leave going until the appeal is finally determined, withdrawn or abandoned. If no in-time appeal is lodged, 3C leave ends when the deadline passes. A late appeal is more complicated. If the tribunal later allows an out-of-time appeal to proceed, section 3C leave may start again, but not backdated. That leaves a gap in between, when you may have no leave at all.

Once the appeal process is finally determined, 3C leave ends. You may still wish to seek permission to appeal further, so check what that means for your status first. Our guide to immigration appeal strategy and evidence covers how appeals are prepared.

What Ends 3C Leave?

Section 3C leave can end in several ways:

  • The Home Office decides your application. If it is granted, your new leave starts. If it is refused, the appeal or review stages above apply.

  • The application is withdrawn.

  • The deadline for an appeal or administrative review passes without one being lodged.

  • Your appeal or review is finally determined.

  • An individual leaves the UK. Leave extended by section 3C lapses if the applicant leaves the United Kingdom.

Section 3C leave can also be cancelled, but only for limited reasons. These are a failure to comply with a condition of the leave, or the use of deception in seeking leave. Cancellation is discretionary, and the Home Office should consider your individual circumstances rather than cancel simply because an application was refused.

Can You Extend Leave Again While on Section 3C Leave?

Generally, no. A person may not make an application for variation of leave while their leave is extended by section 3C. You can, however, amend the application already pending, provided the amendment is a valid application. If you need to change your route later, such as moving from a student visa to a skilled worker visa, take advice on timing before you act.

A new application can be made once 3C leave has ended, for instance after an administrative review is decided. Be careful, though, because a gap in leave can cause serious problems.

Asylum Claims and Section 3C Under Immigration Law

An asylum claim is a separate matter from a variation application. Section 3C does not give an asylum seeker an automatic right to work. Your rights depend on the conditions of your original visa and on the status of the asylum claim. The Nationality, Immigration and Asylum Act 2002 governs the appeal rights that often link to section 3C, so asylum cases need specialist care.

Practical Tips While Your Immigration Application Is Pending

  • Keep proof of the date your application was submitted, and note when your visa expires.

  • Avoid travelling abroad, as it ends section 3C leave.

  • Keep to your existing conditions.

  • Diarise every deadline once a decision arrives.

  • Keep evidence to support your case in one place.

If you are searching for work while on 3C leave, ask the employer to use the Employer Checking Service to confirm your right to work under Section 3C leave.

FAQs

1. How Long Does Section 3C Leave Last in the UK?

Section 3C leave continues while a valid, in-time visa application remains undecided. It may also continue during the permitted period for an appeal or administrative review and while an eligible challenge is pending.

2. Can I Work While on Section 3C Leave?

Yes, if your previous visa allowed you to work. Section 3C leave maintains your existing work conditions, including any restrictions on working hours, employer or type of employment.

3. Can I Travel Outside the UK While on Section 3C Leave?

Leaving the UK automatically ends Section 3C leave under the Immigration Act 1971. Travelling outside the Common Travel Area may also result in your pending visa application being treated as withdrawn.

4. How Can I Prove My Right to Work Under Section 3C Leave?

You may be able to use your eVisa and a share code if your digital status reflects Section 3C leave. Otherwise, your employer can request verification through the Home Office Employer Checking Service.

5. Does Section 3C Leave Count Towards Indefinite Leave to Remain?

Section 3C leave can count towards the 10-year lawful residence requirement for ILR if it extends permission under a qualifying immigration route. Periods extending permission under excluded routes do not count.
